Mr. Ritesh Pandey, Advocate for the respondent. *** There was no representation on behalf of the petitioner on the last date of hearing. Notice was issued to counsel for the petitioners for today. As per office report learned counsel representing respondent submits that in the Court below the case is fixed for defence evidence and arguments. It being so, the private complaint case is likely to be decided in near future. By way of filing the present petition the petitioners are seeking setting aside of the summoning order. They had approached the Court of Sessions challenging that order by way of filing the revision petition which was dismissed. Thereafter they have approached this Court. The trial is at the fag end.

There being no representation on behalf of the petitioners on two successive dates, it comes out that petitioners are not interested in further prosecution of the petition, therefore the same stands dismissed for non prosecution.
