***** ARCHANA PURI, J. (Oral) The present appeal has been filed by the appellants, thereby seeking enhancement of compensation, awarded by learned Tribunal, on account of injuries sustained by him, in a motor vehicular accident, which took place on 09.06.2018.
After having some interaction with both the counsel and after going through the impugned Award, it is evident that there is chance of amicable settlement. Taking into consideration the age of the deceased, who had suffered injuries in the accident in question, who did not suffer any permanent disability as well as taking into consideration his vocation, as evident from paragraph No.21 of the impugned Award and the bills proved, Sonu 2025.11.29 14:24 I attest to the accuracy and authenticity of this document
FAO-1576-2021 (O&M) which are to the extent of Rs.64,793/-, the Insurance company agrees to pay a sum of Rs.60,000/-, over and above the awarded amount of Rs.94,793/-. The said offer is acceptable to the counsel for the appellant. As such, the requisite enhanced amount i.e. Rs.60,000/- be paid by the Insurance Company, to the appellant, within a period of 45 days from today onwards.
In the eventuality of any default, on the part of the Insurance Company, in making the payment, within a period of 45 days, it shall be liable to the penal interest @ 8% per annum, till realization. In view of the aforesaid terms, the FAO is allowed, being compromised.
