Petitioner has preferred this petition under Article 226/227 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus for the release of detenue namely Priya who is claimed to be his wife and is in illegal detention of respondents No.4 to 6.
In pursuance of order dated 14.09.2021, respondent No.3- officiating SHO- SI Suresh has produced Priya in Court through video conferencing.

CRWP No. 7032 of 2021 -2her date of birth is 07.06.2003. Her marriage was solemnized with the petitioner on 29.06.2021 as per Hindu rites and ceremonies at Arya Samaj Vivah Mandir, Rohtak. After the marriage, she lived in the company of the petitioner, but was taken by the private respondents on 03.07.2021 on the assurance that they will honour the marriage and would send her later on when the petitioner will come to take her. On being asked, Priya has shown her willingness to go with the petitioner. She has been repeatedly asked to give her clear consent and she has affirmed that she would go along with the petitioner being his wife.
In view of the aforesaid position, the alleged detenue namely Priya being major is free to go as per her own wish. Respondent No.3 would facilitate to implement the wish of Priya. Petitioner would also be at liberty to take her from the office of Superintendent of Police, Panipat today itself. Disposed of.
