**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 0128 dated 02.7.2020 under Section 21 (b) of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Dhand, District Kaithal. Learned counsel for the petitioner submits that recovery of 8.8 gm heroin was allegedly recovered from the petitioner which is marginally above than the small quantity. He further states that the contraband was weighed along with the pouches and if weighed without pouches it will fall into small quantity. Learned counsel further submits that the petitioner has been in custody since 02.7.2020 and no other case is pending against him.

Learned State counsel, on instructions from SI Dharam Pal, submits that it is a case of recovery of intermediate quantity of the contraband. He further submits that challan was presented on 26.8.2020. GURPREET SINGH 2020.09.

It is a case of recovery of intermediate quantity of the contraband. Admittedly, no other case is pending against the petitioner. The petitioner has been in custody since 02.7.2020 and challan has been already been presented. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
