The petitioner assails order dated 6.8.2020 (Annexure P-7) vide which Block Development and Panchayat Officer-cum-Executive Officer, Panchayat Samiti, Jagraon has passed an order directing the Gram Panchayat, Dangian to immediately surrender the unused amount from Rural Development Fund (RDF) for the year 2016-17.

Learned counsel for the petitioner has submitted that a grant of `10,00,000/- had been received during the year 2016-2017 for the purpose of construction of Dharamshala and for construction of street/drains in the village. ( 2 ) CWP-13059-2020 However, subsequently vide order dated 21.3.2017 (Annexure P-2) it was directed that in case the aforesaid development works have not been initiated the same be stopped and be not started till further orders of the Government and ultimately the impugned order for surrendering the funds has been passed thereupon on 6.8.2020 (Annexure P-7).

Having heard learned counsel for the petitioner, this Court is of the opinion that issuance of directions in the present circumstances for setting aside impugned orders are not warranted. However, it is directed that in case any representation is made by the petitioner-Panchayat projecting the requirement of funds for the purpose of construction of a Dharamshala and streets/drains, the same shall be examined by respondent No.1-Special Secretary-cum-Director, Department of Rural Development and Panchayats, Punjab and needful shall be done thereupon at the earliest. 4.

A copy of this order be sent to the respondent No.1-Special Secretary-cumDirector, Department of Rural Development and Panchayats, Punjab to him to do the needful.
