(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that vide order dated 27.06.2016 (Annexure P-5), the disciplinary authority had directed that his suspension period will be treated as leave of kind due, which according to petitioner is not correct. Further, prayer is that though petitioner had retired from service on attaining the age of superannuation on 29.02.2012, his pensionary benefits were only being released after a period of six years and that too without any valid justification and therefore, he is entitled for interest on the same. Further, grievance is that certain amount has been recovered from the pensionary benefits of the petitioner without giving him any opportunity of hearing.

CWP-14428-2019 -2respondents with a comprehensive legal notice dated 07.04.2019 (Annexure P-15), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 07.04.2019 (Annexure P-15) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
