The petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.11 dated 15.1.2017 registered for the offences under Sections 306 IPC at Police Station Jodhan, District Ludhiana.
Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Ankit Kaushal, learned Advocate has appeared for the complainant and contested this petition.
I have heard learned counsel for the parties and learned
Cr. Misc. No.M-5891 of 2017 (O&M) [2] Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.
From the record, I find that the petitioners have already joined the investigation. A perusal of the FIR shows that the petitioners are not named in the FIR. There is no attribution towards these petitioners. The only allegation is that Mandeep Singh son-in-law of Sukhdev Singh (since deceased) was already married with one Sukhvir Kaur and he refused to keep his wife Manpreet Kaur-daughter of the deceased and there are also allegations that Mandeep Singh got married Manpreet Kaur daughter of Sukhdev Singh (deceased) without disclosing his earlier marriage. At the time of arguments, learned counsel for the petitioners also argued that in the statement of Manpreet Kaur recorded under Section 161 Cr.P.C. she has stated that she was harassed by her in-laws and further dowry articles etc. are still there with the in-laws' family of Manpreet Kaur, the offences under Sections 498-A, 406, 427 and 120-B IPC have been added.
After going through the record and after hearing learned counsel for the parties, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 22.2.2017 passed by this Court granting interim bail to the petitioner is made absolute. It is ordered that in the event of arrest, the petitioners shall be admitted to bail for the offence under Section 306 IPC and the added offences under Sections 498-A, 406, 427 and 120-B IPC in the FIR, on their furnishing
Cr. Misc. No.M-5891 of 2017 (O&M) [3] personal bonds each and surety each to the satisfaction of the Arresting/ Investigating Officer. The petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
