**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 614 dated 9.7.2018 registered at Police Station Model Town, Panipat, District Panipat under Sections 307, 323, 377, 406, 498-A, 506, 34 IPC and Section 27 of Arms Act.

Counsel for the petitioner contends that petitioner is in custody since August 2018 and challan was filed. Counsel further urges that the complainant was earlier married in 2003 and this was her second marriage with the petitioner and there is no date with respect to the incident where the bullet struck the wall. Counsel further submits that according to the complainant, she was turned out of the house on 10.4.2018 and that firing incident would have been earlier but no complaint was given and the FIR has been lodged after three months.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate on the condition that he will deposit the licenced arm, within a week of his release with the police, till the trial is over.
