(ORAL) Present petition has been filed for seeking directions to the respondents to protect life and liberty of the petitioner by providing adequate security as they apprehend threat at the instance of respondent No.6-husband of petitioner No.1.
A short reply filed by way of affidavit dated 21.10.2022 of Rajiv Kumar HPS, DSP, Yamuna Nagar has been filed on behalf of respondent Nos.1 to 5 wherein it is submitted that the allegations levelled by the petitioner were inquired into and statements of the petitioners as well as her husband-respondent No.6 along with other relatives have been recorded with no threat perception having been found. The dispute in question has been sorted out and misunderstanding between the parties stands removed. Petitioner No.1-Monika Aggarwal got her statement (R.1) recorded that she did not wish to take any action against her husband-Hiren Aggarwal, father-in-law/Sushil Aggarwal,
CWP No.13764 of 2022 #2# 2023:PHHC:098655 driver Gunjan Chauhan and niece Neha Gupta. Similarly, statement of respondent No.6-Hiren Aggarwal is recorded vide Annexure R.2. A reply on behalf of respondent No.6-Hiren Agarwal has also been filed today, a copy whereof is handed over to the petitioners. Even, as per the aforesaid reply, the parties have already amicably resolved their differences and a compromise deed dated 03.09.2022 has been executed between the parties. Learned counsel for the petitioner pleads ignorance. Be that as it may, considering the specific response reiterating all the aspects filed by respondent No.
6 in this regard and taking note of the fact that the compromise has been effected between the parties and statements of the parties have been recorded in this regard coupled with the fact that a period of almost ten months has elapsed since the date of filing the said short reply, present petition is disposed of as having been rendered infructuous. Liberty is, however, granted to the petitioner to seek revival of the present petition, in case the aforesaid assertion are found to be incorrect. Petition stands disposed of.
