(ORAL ) Through this petition under Section 439 Cr.P.C., petitioner-Gurwant, has prayed for grant of regular bail in case FIR No.481 dated 4.8.2017, registered under Section 460 IPC (Sections 397, 302/34 IPC added later on) and Section 25 of the Arms Act, at Police Station Assandh, District Karnal. The petitioner is facing trial in a case of dacoity and murder of Jagir Singh, father of complainant Parminder Singh. Learned Counsel for the petitioner contends complainant that Parminder Singh is none else but son of the deceased Jagir Singh, who while appearing as PW.3 before the trial Court has categorically testified that the petitioner is innocent. CRM-M-23898-2019 Copy of statement of complainant is annexed with the present petition as Annexure P-2. As on date, there is no evidence with the prosecution against the petitioner. Conclusion of trial may take sufficient long time. No useful purpose would be served by detaining him in jail. On the other had, learned State counsel has vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner Gurwant is ordered to be released on bail pending trial, if not required in any other case, on his furnishing adequate bail bond and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
