(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 363 dated 19.10.2017 (Annexure P-1) registered under Sections 323, 452 and 506 IPC and Section 25 of the Arms Act at Police Station Pundri, District Kaithal and all subsequent proceedings arising therefrom, on the basis of compromise dated 14.05.2019 (Annexure P-2) effected in between the parties. Pursuant to orders dated 21.01.2020 of this Court, the parties appeared before the Judicial Magistrate Ist Class, Kaithal, on 10.02.2020 to get their statements recorded. Learned Judicial Magistrate Ist Class, Kaithal, submitted his report vide letter No. 148 dated 20.02.2020, duly forwarded by the learned District and Sessions Judge, Kaithal, vide letter No. 412 dated 17.02.2020.

CRM-M-24715-2019 -2According to the report, learned Judicial Magistrate Ist Class, Kaithal, is satisfied that compromise effected between the parties out of their own free wish, without any threat, pressure or undue influence.

In compliance of order dated 21.01.2020, original receipt regarding deposit of costs of `20,000/- has also been produced in Court today. The same is taken on record. Be tagged at appropriate place. Considering the report of Judicial Magistrate Ist Class, Kaithal, dated 20.02.2020 and deposit of costs as well as the fact that the compromise will bring peace and harmony between the parties, aforesaid FIR No. 363 dated 19.10.2017 (Annexure P-1) and all subsequent proceedings arising therefrom, are quashed, qua the petitioner only. Registry is directed to verify deposit of aforesaid costs, with the concerned quarter.
