**** ANOOP CHITKARA, J. (ORAL) Legal aid counsel submits that the peƟƟoner has engaged his private counsel and he has been discharged. Given above, Mr. Yogeshwar D. Kaushik, Legal Aid Counsel is discharged today.

Mr. Tejas Bansal, Advocate has put in appearance on behalf of peƟƟoner and filed memo of appearance, which is taken on record. Counsel for the peƟƟoner submits that amount of fraud was more than Rs. 3.5 crores and a large number of people are involved and all of them want jusƟce.

State counsel submits that the present peƟƟon has been rendered infrucutous because three persons have already been arrested and are being prosecuted. 4.

Given the stand of the peƟƟoner which seems correct, in case, the invesƟgator wants to make one of the accused as an approver and files an applicaƟon for further invesƟgaƟon, the trial Court shall pass the order in accordance with law. 5.

With the above observaƟons, the present peƟƟon stands disposed of with liberty to the peƟƟoner as well as invesƟgator to file an appropriate applicaƟon for further invesƟgaƟon before the trial Court. It is clarified that further invesƟgaƟon shall be done aŌer taking formal permission from the concerned trial Court. It is further clarified that before passing the order of further invesƟgaƟon, appropriate opportunity shall be given to all the stake holders in accordance with law.
