(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.19 dated 02.02.2017, under Section 376 IPC and Section 3 of SC & ST (Prevention of Atrocities Act, 1989), registered at Police Station City Moga, District Moga. At the very outset, learned State counsel, on instructions from investigating officer, has informed that in pursuance of order dated 22.02.2017 of this Court, the petitioner has joined the investigation on 27.02.2017 and his custodial interrogation is not required at this stage. Moreover, the prosecutrix was a major at the time when she was in relation Naresh Kumar 2017.04.06 08:51 I attest to the accuracy and integrity of this document Chandigarh with the petitioner.

CRM-M-5993-2017 -2In view of the totality of the facts and circumstances of the case, order dated 22.02.2017, passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner is made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C.
