Prayer made in the present petition is for quashing of orders dated 15.03.2007 and 11.08.2009, rejecting the claim of the petitioner for release of payment with regard to unutilized earned leave. 2.
Learned counsel for respondent No.2 refers to the Rule 8.21(a)(1) and states that leave encashment benefit of unutilized earned leave upto 300 or 240 days as the case may be, is permissible only once at the time of retirement on superannuation to all classes of employees, but not on reemployment or any other type of fresh employment after superannuation and the aforesaid rule was being misrepresented, to which there was no rebuttal by way of filing replication.
