(ORAL) This is a petition that has been filed for grant of interim regular bail to the petitioner in case FIR No.203 dated 28.11.2019 registered under Section 20 of NDPS Act at Police Station Mouli Jagran, U.T., Chandigarh. Counsel for the petitioner herein would contend that during her custody in aforesaid FIR, the petitioner delivered a baby boy on 06.08.2020 and was kept in Government Medical College and Hospital, Sector 32, Chandigarh for an initial period of 10 days in pursuance of order dated 10.08.2020 passed by this Court in CRWP No.4811 of 2020, which period was extended vide order dated 24.08.2020 passed in CRM-M No.23564 of 2020. It is further contended that the baby boy is only three weeks old and would not get treatment and care, if the petitioner is kept in custody. Therefore, it is prayed that interim bail be granted to the petitioner so that the new born baby can gain strength.

I have heard learned counsel for the parties. Keeping in view the fact that there is outbreak of COVID-19 pandemic and therefore, life of new born baby, who is yet to gain strength might be in jeopardy, the instant petition is allowed and the petitioner is directed to be released on bail for a period of four weeks on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. She shall surrender before the concerned trial Court/Duty Magistrate on 01.10.2020. However, any observation made herein shall not be construed to be an expression on merits of the case.
