Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case Crime No.20/2016 dated 13.05.2016 under Sections 8, 20, 23 and 29 of the NDPS Act, registered at Narcotics Control Bureau, Chandigarh Zonal Office.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the first bail petition of the present petitioner had already been dismissed by this Court vide order dated 29.11.2016. In the present case, charas weighing 1.880 kgs. has been recovered from the petitioner, which falls under commercial quantity. In the earlier order, it has been held that Section 37 of the NDPS Act bars benefit of bail to the accused in the case of commercial quantity. CRM No.M-6029 of 2017 -2The recovery from the present petitioner falls under commercial quantity and Section 37 of the NDPS Act bars the benefit of bail to the accused in the case of commercial quantity.

Therefore, finding no merit in the present petition, the same is dismissed.
