    As per the office report, notice issued to the respondent has been received back served. However, he remains unrepresented. This is an application filed by the wife with a prayer to transfer the proceedings of the petition filed under Section 9 of the Hindu Marriage Act, 1955, titled as "Pargat Singh vs. Kamaljit Kaur" pending in the Family Court, Bathinda, to the Court of competent jurisdiction at Moga. The petitioner claims that the respondent is already defending the following two proceedings:-

1. A complaint under Section 125 Cr.P.C.

2. Under Section 12 of the Protection of Women from Domestic Violence Act, 2005.

The petitioner claims that the distance between Bathinda and Moga is 80 kms. and the petitioner is residing at Moga with her aged parents. The petition filed under Section 9 of the Hindu Marriage Act, 1955, titled as "Pargat Singh vs. Kamaljit Kaur" pending in the Family Court,

The transferor Court is requested to remit the case file to the transferee Court forthwith.
