Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail in case FIR No.16 dated 30.1.2016 under Sections 420,193, 199, 200,120-B IPC,PS Civil Lines,Batala.
Petitioner-accused Sukhjit Kaur is grand mother of Gurbaz Singh,whose agricultural land measuring 7K13M was illegally sold by his co-accused father Gurdial Singh in favour of present accused vide sale deed dated 8.7.2015. Allegations are that permission for sale was sought by mis-representation of facts before the Court. Be that as it may, the petitioner-accused is ready and willing to transfer back the land in question to her grand son-Gurbaz Singh.
Learned counsel for the petitioner submits that in terms of RAJINDER PRASHAD JOSHI 2016.05.30 18:00 I attest to the accuracy and integrity of this document
CRM-M 9910/2016 her undertaking on the previous date the land in question has since been re-transferred vide deed dated 24.5.2016 in favour of her grand son Gurbaz Singh and hence seeks confirmation of interim bail. Learned counsel for the complainant acknowledges the fact of re-transfer of the land in favour of Gurbaz Singh and does not oppose confirmation of interim bail. He further concedes that negotiations for an amicable settlement for even seeking quashing of the FIR are in the process.
Learned State counsel on instructions and in view of the aforesaid development does not oppose the confirmation of interim bail.
In view of the above, interim bail granted on 29.3.2016 is made absolute.
Disposed of.
