JITENDRA CHAUHAN, J. (Oral) The instant petition has been preferred under Section 439 Cr.P.C. seeking regular bail in FIR No.519 dated 16.07.2012, registered under Section 409 of the Indian Penal Code, at Police Station City Sirsa, District Sirsa.

Learned counsel for the petitioner contends that the petitioner is ready and willing to discharge his entire liability within three months. To show his bona fide, he will deposit Rs.1 lakh within ten days from today in the Employees' Provident Fund Account of Haryana Vidyut Parsaran Nigam Ltd. (HVPN), which will further be disbursed to the beneficiaries. The second installment of Rs.1 lakh shall be paid within four weeks thereafter and the remaining amount of Rs.1,80,000/- shall be paid within six weeks thereafter.

On the other hand, learned State counsel has opposed the instant petition and submits that the petitioner has evaded the payment to the workman, which amounts to unfair labour practices and no leniency Virendra Singh Adhikari 2017.03.03 10:27 I attest to the accuracy and authenticity of this document High Court Chandigarh

In view of the above, without adverting to the merits of the instant case, this petition is allowed. The petitioner-Pardeep Dhankar be admitted to bail during the pendency of the trial, on his furnishing bail bonds and surety bonds, to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned.
