(Oral) This is a petition challenging the order of the trial Court declining to summon the two brothers-in-law and their wives(Jeth and Jethani) as additional accused in case under Section 304B IPC. The daughter of the petitioner was married and died within eight months of the marriage by ingestion of sulphas tablets. The husband and mother-in-law were indicted and the respondents no. 2 to 5 were kept in column No.2.

Learned counsel for the petitioner has argued that once there was common residence and common mess and there were allegations of dowry harassment the trial Court was not justified in dismissing the petition.

  Learned counsel for respondents No. 2 to 5 on the there hand has argued that as against these respondents the allegations are extremely vague and the trial Court has rightly rejected the application. As per him, at the most in the worst case scenario the daughter of the complainant may have committed suicide on account of differences with her husband but the allegations under Section 304-B IPC as against these respondents do not stand the scrutiny of the law.

I find myself in agreement with learned counsel for the respondents. In my opinion at this stage the order of the trial Court cannot be faulted.

Petition is dismissed.

Since the main case has been decided, the Criminal Misc. Application, if any, also stands disposed of.
