Petitioner has filed this second petition under Section 439 read with Section 482 Cr.P.C. for grant of interim bail in case FIR No.49 dated 17.05.2018 under Sections 302, 506 and 34 IPC, registered at Police Station Sujanpur, District Pathankot.

Notice of motion was issued. Learned State counsel appeared. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. Learned counsel for the petitioner contended that this petition has been filed for grant of interim bail to the petitioner (pregnant lady) and she has given birth to a child one day earlier and she is still in Intensive Care Unit (ICU). CRM No.M-52142 of 2018 -2may be granted interim bail due to her ill health and to enable her to look after her newborn child. Learned State counsel has not contested all these facts.

Keeping in view the facts and circumstances of the present case, the present petition is allowed. The petitioner is directed to be released on interim bail for three weeks, subject to the satisfaction of the trial Court/CJM concerned. The petitioner is directed to surrender herself on 30.01.2019 at 10.00 a.m.
