(Oral) The allegations against petitioner Ajay Kumar in this regular bail application under section 439 Cr.P.C. are that on 6.11.2011, the petitioner along with his co-accused had assaulted complainant Kuljit Singh. The petitioner is attributed injuries above right ear, right palm and right index finger and as per evidence including testimony of the doctor, the aforesaid injuries at the most are grievous in nature and that the petitioner is behind the bars since long and the trial is not likely to be concluded in the near future.
Keeping in view the substantive period of incarceration, there being debatable issue in the absence of medical evidence about the injuries being dangerous to life and the fact that the trial is not likely to be concluded in near future, without adverting to the merits of the case, the instant application is allowed.
