Mr.Kirat Singh Sidhu,DAG Punjab assisted by ASI Satwinder Singh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to accused-petitioner Barinder Singh in case FIR No.172 dated 6.12.2015 under Sections 420,406 IPC,PS Mukerian,District Hoshiarpur.
Allegations by complainant Varinder Singh are that the present petitioner-Barinder Singh and his co-accused brother Nathu Ram had received a sum of Rs. 5 lacs alongwith passport from him on the pretext of sending him to New Zealand. Neither the complainant was sent abroad nor the amount and the passport returned. It was contended that the main allegations were against the co-accused Nathu Ram who is stated to have absconded, therefore, the petitioner being the brother of Nathu Ram has been falsely roped in. CRM-M 9932/2016 Vide order dated 21.3.2016 notice of motion was issued with a direction to petitioner to join investigation and interim protection was granted to him.
At the time of hearing,learned counsel for the petitioner states that petitioner has joined investigation and fully cooperated. Learned State counsel on instructions does not refute the fact of petitioner joining investigation and further states that custodial interrogation of the petitioner is not required.
In view of the above,interim bail granted vide order dated 21.3.2016 and further extended vide order dated 23.5.2016 is made absolute.
Disposed of.
