(ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of interim bail to the petitioner till 05.12.2018 to perform the last rites of his father, who died on 21.11.2018. Learned State counsel, on instructions, from ASI Rohtash, Police Station Gannaur, Sonepat certifies that the last ceremony of the father of the petitioner herein is fixed for 03.12.2018. Considering the above factual position but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, the petitioner is ordered to be released on interim bail till 05.12.2018, on his furnishing adequate bail bonds/surety bonds to the satisfaction of trial Court/Duty Magistrate concerned, with the direction to the petitioner to surrender at Jail Gate on 05.12.2018 at 5:00 P.M.
