By way of this petition filed under Section 528 of BNSS, 2023, the petitioner is seeking quashing of FIR No.194 dated 29.03.2025 for offence punishable under Sections 121(1), 132, 221, 3(5), 324(4) of BNS, 2023 registered at Police Station Sector-10, District Gurugram and consequential proceedings arising therefrom, on the basis of compromise dated 23.04.2025 (Annexure P-6) and affidavits dated 11.04.2025 (Annexure P-2 to P-5). 2.

Vide order dated 26.05.2025 passed by Coordinate Bench of this Court, the parties were directed to appear before the learned trial Court/Illaqa Magistrate on 15.07.2025 for getting their statements recorded regarding the compromise arrived at between them and the Court concerned was further directed to get the statements of the parties recorded qua the compromise so arrived at between them and to submit a report in this regard. 3.

Copy of report has since been received from learned Judicial Magistrate Ist Class, Gurugram in pursuance of the directions of this Court, wherein, the factum of the compromise arrived at between the parties stands Sonia Puri 2025.08.12 11:28 I attest to the accuracy and integrity of this document

As per the report, compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the private respondents have also made a statement to the effect that they would have no objection if the FIR qua the accused-petitioners is quashed. 4.

The Trial Court has annexed a copy of the statement of the respondent-party so recorded, alongwith its report. 5.

Learned State counsel also submits that there is no accused person other than the petitioners, and the private respondents are the only aggrieved persons in the FIR in question. The petitioners are not involved in any other case.  6.

In view of the report of the learned Judicial Magistrate Ist Class, Gurugram and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed and FIR No.194 dated 29.03.2025 for offence punishable under Sections 121(1), 132, 221, 3(5), 324(4) of BNS, 2023 registered at Police Station Sector-10, District Gurugram and consequential proceedings arising therefrom, are quashed qua the petitioners subject to payment of costs of Rs.5,000/- each to be paid to the High Court Civil Dispensary. 7.
