(ORAL) Counsel for the petitioner states that though an FIR No.22 dated 24.02.2008 under Section 376 IPC was registered against the petitioner and he was suspended from service on 26.02.2008, no action was taken by the respondents department till the petitioner had attained the age of superannuation and retired w.e.f. 04.04.2008, vide order dated 03.04.2008 (Annexure P-2). Thereafter, the petitioner was convicted vide judgment dated 08.05.2009, passed by the Sessions Court, Bathinda, for a period of ten years, which period the petitioner has already undergone. Counsel for the petitioner argues that after the release from prison, petitioner has submitted a representation dated 24.02.2019 (Annexure P-6) seeking release of the pensionary benefits to the NARESH KUMAR 2019.05.28 15:16 I attest to the accuracy and integrity of this document Chandigarh

CWP-14097-2019 -2respondents, but no action has been taken by the respondents for the release of the benefits, which the petitioner is entitled in respect of service which he had rendered with the respondents.

Counsel for the petitioner states that at this stage the petitioner will be satisfied, in case a time bound direction is issued to the respondents to decide the representation dated 24.02.2019 (Annexure P-6) by passing an appropriate speaking order. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 24.02.2019 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order.
