Learned counsel for the petitioner contends that the petitioner has neither been named in the FIR nor any role has been attributed to him, and that he has been indicted as an accused on the basis of disclosure statement of co-accused, Lakhanpal. He claims parity with similarly situated co-ccused, Ramandeep, who has been granted regular bail by this Court vide order dated 14.08.2020 (Annexure P-2). & CRM-M-25104-2020 Chander, opposes the prayer made in the present petition and submits that injuries on the person of injured, Gurvinder and Satyawan, are on their vital parts.
I have heard the learned counsel for the parties. The petitioner has been indicted as an accused on the basis of disclosure statement of co-accused. The challan has been presented. The petitioner has been in custody since 17.06.2020. Trial of the case would take time to conclude. Moreover, similarly situated co-accused has been released on regular bail. Therefore, no useful purpose would be served by keeping him behind the bars.
