Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 23 dated 17.04.2015, registered under Section(s) 307, 427, 506, 148 & 149 IPC and Section 25 of the Arms Act, 1959 at Police Station Sadar Batala, District Batala. Learned counsel for the petitioner contended that petitioner was in custody in another case; he was released from custody on 11.08.2018 and he was informed about the next date to be 20.09.2018. However, when he checked up, he came to know that actual date fixed before the Court was 20.08.2018 and because of that he could not appear in the Court. Otherwise, there was no reason for him not to appear in the Court after granting bail from the Court of Sessions and he has assured to be punctual and regular regarding appearance in the Court proceedings. Criminal Misc. No. M-52193 of 2018 directions that petitioner shall appear before the Court of Additional Sessions Judge, Gurdaspur, which had cancelled his bail and he shall move an appropriate application for grant of bail. The learned Court concerned shall admit him on fresh bail on his furnishing fresh bail bonds and surety bonds to its satisfaction. However, the concerned learned Additional Sessions Judge shall proceed to complete the proceedings under Section 446 Cr.P.C.
