Learned counsel for the respondents/State has submitted that in pursuance of the order passed by a coordinate Bench of this Court on 06.08.2025, a detailed speaking order dated 12.05.2026 has been passed by respondent No.2. A copy of the said speaking order has been handed over to this Court during the course of arguments, which is taken on record. The relevant portion of the said order is reproduced hereinbelow: "On the basis of above, it is concluded that:-

1. The records mentioned in the above table under Sr. No. A mentioned at point no.1,3,4,5,6,7, under Sr. No. B mentioned at point no. 8,9,12,13, under Sr. No. C mentioned at point no. 14,15,18,19 and under Sr. No. D mentioned at point no. 24 has been handed over on 09.05.2026 and under Sr. No. A mentioned at point no. 2, under Sr. No. B mentioned at point no. 10,11, under Sr. No. C mentioned at point no. 16,17 and under Sr. No. D mentioned at point no. 23 had already been handed over to

the petitioner- the present Sarpanch. Whereas, the record mentioned at point no. 2,10,11,16,17 and 23, in the above table has been demanded by the petitioner again vide such application wrongly, as the same had already been taken over by her and recorded her signature against the receipt thereof on the charge list.

2. The record mentioned under Sr. No. D mentioned at point no. 20,21,22 and 25 pertaining to Panchayat Fund are yet to be handed over by the Ex-Sarpanch and the then Gram Sachiv namely Kailash Chand (now retired). Hence, on the basis of above conclusion it is ordered as under:-

1. The present Sarpanch is directed to maintain the record diligently and carefully as she has demanded the record mentioned at point no. 2,10,11,16,17 and 23 again vide application dated 13.08.2025. Whereas, she had already received such record and recorded signature as acknowledgement thereof on the charge list (1-17).

2. Against the Ex-Sarpanch Smt. Jaida and the then Gram Sachiv namely Kailash Chand (now retired), Gram Panchayat Aklimpur Nuh, in compliance of the directions issued by the Deputy Commissioner, Nuh vide letter no. 2932 dated 16.11.2023, an FIR is ordered to be registered for non-maintenance of record properly and non-handing over the same mentioned at point no. 20,21,22 and 25 pertaining to Panchayat Fund to the present Sarpanch." 2.

It has been highlighted that the specific record which has been handed over to the petitioner has been detailed in the said order and it has also been recommended that an FIR be registered for non-maintenance of record properly.

Learned counsel for the petitioner has submitted that the present contempt petition be disposed of but liberty be granted to the petitioner to institute appropriate proceedings in case any grievance of the petitioner is still left.

In view of the above, the present contempt petition is disposed of with liberty aforesaid.
