-.- AMIT RAWAL J. (ORAL) The prayer in the revision petition is for stay of the execution of the sale deed in pursuance of the judgment and decree passed in suit for specific performance.
Mr. Bhatia, learned counsel for the petitioner submitted that regular second appeal bearing No.3463 of 2017 is pending wherein status quo has been granted. The possession is with the decree holder and he is carrying own with further execution as indicated above regarding the sale deed.
I am afraid aforementioned prayer cannot be acceded to in the manner and mode the petitioner-judgment debtor has sought. If there is some headway in the execution other than possession, which was not in existence at the time of hearing of regular second appeal while granting interim stay, the appropriate remedy for the petitioner is to move an appropriate application in the pending regular second appeal and not the objections.
In view of aforementioned facts, I do not find any PANKAJ KUMAR 2019.05.31 18:25 I attest to the accuracy and integrity of this document
