**** JAISHREE THAKUR, J. (ORAL) CRM-17764-2017 Criminal miscellaneous application is allowed as prayed for. Annexures P-3 to P-6 are taken on the record. CRM-M-6179-2017 The prayer in the instant petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.334 dated 20.06.2016 for the offence under Sections 363, 366, 376D, 506, 34 IPC and Section 6 of Protection of Children from Sexual Offences Act, 2012, registered at Police Station Samalkha, District Panipat. Learned counsel for the petitioner contends that the petitioner has been in custody since 24.06.2016 and out of total 21 witnesses 11 witnesses are yet to be examined who are all formal in nature. It is also contended that all the examined witnesses have not supported the prosecution. The bail application is vehemently opposed by learned counsel appearing on behalf of the respondent-State.
I have heard learned counsel for the parties. The trial is likely to take some time as out of 21 witnesses, 11 witnesses are yet to be examined. The witnesses who have been examined as on date have not supported the prosecution case. Therefore, without commenting anything on the merits of the case, petitioner be released on regular bail on furnishing his bail bonds/sureties to the satisfaction of Duty Magistrate/Illaqa Magistrate/trial Court, concerned.
