(Oral) The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No. 134, dated 17.11.2016, under Section 376-D of IPC, 1860, registered at Police Station Patti, District Tarn Taran (Annexure P-1) as well as in the Summoning Order dated 27.09.2018 (Annexure P-6), whereby, the petitioner was summoned. Learned counsel for the petitioner states that pursuant to order dated 07th December, 2018, passed by this Court, the petitioner has joined investigation. Learned State counsel on instructions from ASI Balwinder Singh, states that the petitioner is no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 07th December, 2018, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
So far as, prayer for setting aside of summoning order dated 27.09.2018 (Annexure P-6) is concerned, learned counsel for the petitioner prays for withdrawal of the same with liberty to raise all the pleas before the trial Court. Ordered accordingly.
