RAMENDRA JAIN, J. (ORAL) Through instant third petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.490 dated 07.05.2018 registered under Sections 20 and 25 of the Narcotic Drugs and Pshychotropic Substances Act, 1985 and Sections 406 and 420 IPC at Police Station Sadar Karnal, District Karnal. According to the prosecution, on 07.05.2018 petitioner along with his co-accused was having conscious possession of 45 kgs of ganja patti without any licence or permit.

Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 07.05.2018.
