The petitioner prays for the issuance of a writ in the nature of mandamus to direct the respondents to grant him the benefit of 6% annual increment as per the instructions dated 05.11.2018. The petitioner is working as a male staff nurse in the Swami Vivekananda Drug De-addiction and Treatment Centre, Government Medical College, Amritsar, since 2015. While relying upon the communication sent by the incharge of Swami Vivekananda Drug De-addiction and Treatment Centre, Government Medical College, Amritsar, the petitioner contends recommending the petitioner's case to the Deputy Commissioner for grant of the benefit of annual increment.

On instructions from Ms. Gurmeet Kaur, Law Officer, Ministry of Health, Punjab, the learned counsel representing the State of Punjab submits that the matter is under the active consideration of the Deputy Commissioner, who is likely to take an appropriate decision in accordance with law within a period of 15 days, from today. Keeping in view the aforesaid facts, this Court is of the considered view that the petitioner's claim shall be evaluated and decided by the Deputy Commissioner in first instance. The Deputy Commissioner shall issue a reasoned order, ensuring that the opportunity of hearing is granted to the petitioner.

Disposed of accordingly.

All the pending miscellaneous applications, if any, are also disposed of.
