Prayer made in the present petition is for directing respondent No.2 to fix the revised pension of the petitioner at par with Beiram Singh, junior to him. It is recorded in order dated 07.03.2012 by the President of the Daily Pre-Lok Adalat that respondent had stated that the petitioner had already been granted the relief of revised pension and revised death-cum-retired gratuity.

Learned State counsel refers to para No.1 of preliminary submissions of the written statement, which reads thus: "1.

That the petitioner has retired from Government service on superannuation on 31.10.1996 and his seniority has been re-fixed as ordered by the Hon'ble Court. He was at Sr. No.28A below Sh. Biram Singh and above Sh. Dhop Singh vide order dated 23.12.2005/09.01.2006. Further he was given promotion w.e.f. 13.10.1971 when his junior Sh. Biram Singh was promoted as Inspector. Sh. Biram was retired from Government service on superannuation on 1.2.1999 and he earned three increments more than the petitioner. The petitioner was retired on 31.10.1996, which is prior to Sh. Biram Singh. The continuation of the petitioner is wrong and hence the petition of the petitioner be dismissed."
