Kashmir Singh v. State Of Punjab And Another
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-52299 of 2018 Date of Decision: 28.11.2018 Kashmir Singh ....Petitioner
Versus
State of Punjab and another ....Respondents CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present:- Mr. Mohit Rampal, Advocate, for the petitioner. RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing FIR No.42 dated 21.03.2012 registered under Sections 420, 34 IPC and Sections 3, 5, 8, 9, 14(2), 15, 18 and 21 of the PUDA Act, 1995 at Police Station Ajnala, District Amritsar Rural along with all subsequent proceedings arising therefrom. After hearing learned counsel for the petitioner, this Court finds that instant petition is completely frivolous inasmuch as trial is going on and some prosecution witnesses are yet to be examined. So it is pre-mature to say that innocence of the petitioner is proved from the statements of three prosecution witnesses beyond doubt.
Dismissed.
