Learned counsel for the petitioners has pointed out that the petitioners had built their houses and were in possession of the same since prior to 2004. The ejectment order was passed on 05.02.2020. Though the said ejectment order was not challenged by the petitioners, however, they had moved a representation dated 14.01.2026 (Annexure P-5) to the Block Development and Panchayat Officer, Ballabgarh to consider their case for regularization of their houses. The Block Development and Panchayat Officer concerned took no decision on the same and in the interregnum their houses were demolished.

Learned counsel for the petitioners, at this stage, states that the petitioners would be satisfied if they are given an opportunity to file an
-2application before the Gram Panchayat, Village Mahmadpur, in accordance with law, for regularization of their houses which had been built by them since prior to 2004.

Per contra, learned counsel for respondents No.1 to 7 states that the Block Development and Panchayat Officer is not an authority under the SOPs and the application, if any, is to be filed before the Gram Panchayat, Village Mahmadpur.

We have heard the learned counsel for the parties. 5.
In view of the submissions made by the learned counsel for the parties and the fact that the petitioners had been residing in the houses since prior to 2004 as per the averments made in the writ petition, coupled with the fact that an application had been filed before the Block Development and Panchayat Officer concerned on 14.01.2026 (Annexure P-5) for regularization of the houses, we deem it appropriate to grant one opportunity to the petitioners to move an application before the Gram Panchayat, Village Mahmadpur in accordance with law.

In view of the above and without commenting upon the merits of the case, the present writ petition is disposed off and the petitioners are granted one opportunity to file an application before the Gram Panchayat, Village Mahmadpur in accordance with law within a period of seven working days from today. The Gram Panchayat, Village Mahmadpur shall consider the same within a period of 15 days thereafter from the date of receipt of the same, in accordance with law.

Till such time the said application moved by the petitioners is decided by the authorities concerned, status quo, as it exists today, shall be maintained.
