***** ARCHANA PURI, J. (Oral) As observed in the order dated 20.08.2025, counsel for the respondent had given a statement that he has no objection if the transfer application is allowed.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/224/2023, titled 'Deepak Vs. Nirmala Devi', filed by the respondenthusband, pending in the Family Court, Jind and she seeks transfer of the same to the Court of competent jurisdiction at Hisar. As evident from the contents of the application, there is one daughter born from the wedlock of the parties, who is about 61⁄2 years old and is in the care and custody of the applicant. The maintenance petition has already been decided in favour of the applicant and the execution qua the same, is pending in the Courts at Hisar.

TA-666-2024 In view of the aforesaid fact situation and considering the statement given by the counsel for the respondent, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/224/2023, titled 'Deepak Vs. Nirmala Devi', filed by the respondenthusband, stands transferred from the Family Court, Jind, to the Court of competent jurisdiction at Hisar. The requisite record of the aforesaid case be sent by the Family Court, Jind, to the District and Sessions Judge, Hisar. Learned District and Sessions Judge, Hisar, shall assign the said petition to the Family Court, Hisar. Even, the parties are directed to appear before the Family Court, Hisar, within a period of one month from today onwards.
