**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 175 dated 16.8.2018 registered at Police Station Ajnala, District Amritsar Rural, Amritsar under Sections 363, 366-A IPC (Section 120-B IPC was added later on) and Sections 4, 6 of Protection of Children from Sexual Offences Act, 2012.

Counsel for the petitioner contends that petitioner is in custody since 20.9.2018. Counsel further submits that petitioner is the brother of Nishan Singh who is said to have enticed the girl. Counsel also contends that it was a run away couple and they had approached the High Court for protection and copy of the order is available. Counsel further submits that the girl was recovered but she has not made any statement. State counsel submits that the girl was recovered on 8.11.2018 and she is with her parents but she is yet to make a statement to the police. Crl. Misc. No. M-52320 of 2018 -2The allegations against the petitioner are that he assisted his brother in enticing the girl. As per the prosecution, age of the girl was 17 years and 7 months.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
