The petitioner is alleged to have been found in possession of 100 grams of intoxicating powder, containing Diphenoxylate Hydrochloride. The petitioner was arrested on 20.7.2014. He had been granted the concession of interim bail on 28.8.2014 to await the report of Chemical Examiner. On receipt of report of Chemical Examiner, he was taken in custody on 24.11.2015.
Learned State Counsel, on the instructions of HC Gurmit Singh, informs that all the prosecution witnesses have already been examined and the case is fixed for final arguments before the trial court. In view of the above circumstances, the petition is disposed of with liberty to raise all the pleas of defence before the trial court to seek benefit, if any, in accordance with law.
