 Ajay Kumar @ Ajay Singh has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 (for brevity, 'Cr.P.C.') for grant of anticipatory bail in case FIR No.19 dated 10.03.2016, registered at Police Station Mahilpur, District Hoshiarpur, under Sections 324, 323, 506, 148 and 149 IPC and Section 326 IPC added later on. Notice of motion was issued in this case.

Mr. Deep Singh, Asstt. Advocate General, Punjab, has put in appearance on behalf of the respondent-State and Mr. A.S.Gill, Advocate has put in appearance on behalf of the complainant and contested this Rajesh Kumar 2017.01.25 11:21 I attest to the accuracy and authenticity of this document.

I have heard learned counsel for the petitioner; learned State counsel as well as learned counsel for the complainant and have gone through the record.

From the record, I find that the present petitioner is named in the FIR. He was stated to be armed with dattar. Injury No.3 is attributed to him,which was given to the complainant on her right elbow and the same is declared as simple one. The present petitioner has not given any grievous injury. He is stated to be a college student. Keeping in view the facts and circumstances of the present case; without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed.
