Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 144 dated 31.10.2016, registered under Section(s) 323, 307 & 34 IPC and Section 25 of the Arms Act, 1959 at Police Station Sadar, Hoshiarpur, District Hoshiarpur. Learned counsel for the petitioner contended that petitioner was earlier admitted to regular bail and had been appearing regularly before the learned trial Court, but he could not appear before the learned trial Judge on 10.04.2019, the date fixed in the case, because of marriage of his real sister and to that effect, he had already intimated to his counsel, who failed to take the required steps. Learned counsel further contended that now petitioner is ready to surrender before the learned trial Court and furnish fresh bail bonds.

Criminal Misc. No. M-24492 of 2019 General, accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week and moves an application for granting him bail, the learned trial Judge shall admit him to bail on his furnishing fresh bail bonds and surety bonds to his satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
