ARVIND SINGH SANGWAN J. (Oral) This is the second petition filed under Section 439 Cr.P.C., for grant of regular bail to the petitioner in FIR No.93 dated 03.05.2017 registered under Sections 148, 149, 323, 302 IPC at Police Station Baroda, District Sonepat.
The first petition was dismissed as withdrawn on 06.09.2018.
Counsel for the petitioner has submitted that, thereafter, the statement of some of the prosecution witnesses has been recorded and he has filed the present petition on the basis of the evidence, which has come on record.
Since, some of the evidence is recorded, it would be appropriate to relegate the petitioner to first approach the trial Court. Accordingly, this petition is disposed of with liberty to the petitioner to file afresh application, in view of the changed circumstances, before the trial Court.
