Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to grant the applicable family pension, in relation to Sh. Krishan lal @ Kishan Lal (Sanitary Daroga) to the petitioners and further to grant interest @ 18% per annum for the period of delay in release of applicable family pension to the petitioners.

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding representation dated 16.04.2024 (Annexure P-4). He submits that at this stage, petitioners would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 and 2. On the asking of the Court Mr. Shobhit Phutela, Advocate, who is on the panel of Department of Local Government, Punjab, has accepted notice on behalf of respondent No.3 and have no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3, to decide representation dated 16.04.2024 (Annexure P-4), expeditiously submitted by the petitioners by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
