(Oral) CRM-14064-2017 Learned State counsel submits that he does not want to file reply to the present application and has no objection if the same is allowed. Learned counsel for the petitioner submits that during the course of investigations, offences under sections 409, 120-B IPC have been added.
In the light of the aforesaid, the present application is allowed. Registry to make necessary addition in the head note of the main petition. CRM-M-6333-2017 The allegations against petitioner Yogesh in this regular bail application under section 439 Cr.P.C. are that around 22.1.2017 he was instrumental in diverting the Urea which was meant to be supplied at subsidized rates, in the open market at higher price. Criminal Misc. No. M-6333 of 2017 (O&M) -2The contentions of the counsel for the petitioner are that the petitioner is in custody since 22.1.2017 and that the trial is not likely to be concluded in the near future. On behalf of the State the bail is sought to be opposed vehemently on the ground that the petitioner has committed offence which has social repercussions.
Keeping in view the substantive period of incarceration and the fact that the trial is not likely to be concluded in near future, without adverting to the merits of the case, the instant application is allowed. Bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Jhajjar.
The present petition stands disposed off accordingly. The observations made herein above shall not be binding on the trial court at the time of trial as these are purely for the disposal of the present bail application.
