The petitioner is seeking regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in FIR No.56 dated 05.03.2025, under Sections 20(c) of the NDPS Act 1985, registered at Police Station Ding, District Sirsa.

Learned counsel for the petitioner submits that the case of the prosecution is that petitioner was found in possession of 10 Kg 470 grams of Ganja and his co-accused namely Sishupal was also apprehended along with 10 Kg 400 grams of Ganja. The FSL report regarding the contents of the contraband has not come forward till date. It is stated that in view of the order passed in Inderjit Singh @ Laddy Vs. State of Punjab, 2014(3) RCR (Criminal) 953, it has been observed by our own Hon'ble High Court that the Presiding Officer of a Special Court dealing with NDPS cases wherever the need is felt and where the matter is being unnecessarily delayed, may grant ANIL KUMAR 2025.07.28 11:38 I attest to the accuracy and integrity of this document

CRM-M-23311-2025 interim bail till the receipt of the Forensic Science Laboratory report and thereafter, consider the case after the receipt of report. 3.

Notice of motion.

Mr. Amrik Narwal, DAG, Haryana., accepts notice on behalf of the respondent-State. Learned State counsel has filed the custody certificate in the Court today, which is taken on record. As per custody certificate dated 23.07.2025, the petitioner is in custody since 04 months and 16 days and he is not involved in any other case. He further submits that FSL report is still awaited and the case is under investigation.

I have heard the learned counsel for the parties and perused the record.

In view of the statement of the learned State counsel, this petition is disposed of. In the meanwhile, the petitioner is granted concession of interim bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned till the filing of FSL report. When the FSL report is received and challan is prepared, the petitioner is directed to surrender before the court and seek regular bail.
