RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.265 dated 09.09.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Sadar, Sirsa, District Sirsa.
According to the prosecution, on 09.09.2018, 900 capsules of Parvorin-spans (Tramadol Hydrochloride) were recovered from the conscious possession of co-accused of the petitioner, namely, Gurcharan Singh and Manjeet Singh. During investigation, it was found that they purchased the abovesaid contraband from the petitioner. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged contraband was a narcotic substance. Petitioner is in custody since 09.09.2018.
