(Oral) The present petition is for quashing of order dated 31.01.2017 whereby application dated 24.01.2017 for recalling of witness i.e P.W.7Jai Ram for further cross examination, was dismissed Learned counsel for the petitioner submits that above said witness has been cross examined by one counsel namely Sh. B.L. Soni, Advocate in a very casual manner and general manner and the witness has not been cross examined thoroughly with regard some specific questions. Thus, the petitioner has engaged a new counsel who has filed the above said application, which was dismissed.

This argument is liable to be rejected as all the above said facts were in the knowledge of the learned counsel appearing for the accused/petitioner right from the beginning. Further reference can be made to a judgment of Baldev Singh vs. State of Punjab 2007(3) RCR Crl 826 (P&H).

CRM-M-6409 of 2017 A bare perusal of impugned order further shows that the above said witness was cross examined on 27.03.2015 and the evidence was closed on 11.05.2016. the present application was moved on 24.01.2017.

Since P.W.7 was cross examined at length by Sh. B.L. Soni, Advocate, no ground is made out to interfere in the order dated 31.01.2017.

Dismissed.
