The prayer made in the present petition is for directing the respondents to consider the candidature of the petitioner in pursuance to advertisement dated 20.02.2023 for the post of Patwari under the Sports SC (R&O) category.

Learned counsel would submit that the petitioner is a Judo player, who had secured 3rd position in the 43rd National School Games Championship and a Grade 'B' certificate was also issued in his favour on 07.09.1998, Annexure P-9, while the requirement as per the advertisement is of having secured 1st, 2nd or 3rd position in State Level Championship. His marks in the Part-B exam are 68.43 marks while the ones, who were selected, had 40.15 and 59.06 under the Sports SC (R&O) category. In this regard, a representation dated 01.12.2023, Annexure P-7, has been submitted by him, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to respondent Nos.1 and 2 to decide the same in a time bound manner by granting him an opportunity of HAMANT 2024.05.21 17:05 I attest to the accuracy and integrity of this order/judgment

At the asking of the Court, Mr. Arun Gupta, DAG, Punjab accepts notice on behalf of the respondents and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondent Nos.1 and 2 to decide the representation dated 01.12.2023, Annexure P-7 within a period of three months which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
