AMOL RATTAN SINGH, J (ORAL) Learned counsel for the petitioner has pointed out that as per the post-mortem report (P.2), deceased Bogha Singh had sustained only one injury on his shoulder, whereas the allegation in the FIR is that the petitioner attacked him with a stick on his head and other parts of the body.

On query, learned State counsel on instructions from ASI Darshan Singh, submits that one prosecution witness out of 14 has been examined so far.

It is seen that the petitioner has put in more than one year of actual custody as per the custody certificate filed by the State counsel in court today.

Keeping in view the aforesaid circumstances but without making any comment on the actual merits of the case for or
